COVID-19 Data Reporting to Become a Medicare Condition of Participation

The Centers for Medicare & Medicaid Services (CMS) has issued an interim final rule revising regulatory requirements related to the COVID-19 public health emergency. Among the provisions finalized, CMS establishes new requirements in the hospital and critical access hospital Conditions of Participation that require hospitals to report certain COVID-19-related data elements to the Department of Health and Human Services (HHS) on a daily basis.

State Offers Free One-Time, 30-Day Supply of PPE From Stockpile

On May 14, the California Department of Public Health (CDPH) announced in All Facilities Letter 21-15 that the Statewide Logistics Task Force has authorized all health care providers and Emergency Medical Services (EMS) responders to access the state inventory to request a one-time, 30-day sustainment supply of personal protective equipment (PPE). This 30-day supply is free of charge and may be used for stockpiles or in daily operations. Health care providers and EMS responders may request this 30-day supply irrespective of the current state of commercial supply chains.   

This is currently one-time initiative that will end on June 15.

CDPH Hospital Survey for COVID-19 Vaccine Distribution
The California Department of Public Health (CDPH) will soon release a COVID-19 vaccine hospital survey via an All Facilities Letter (AFL). The survey results will inform how the state allocates doses of the COVID-19 vaccine, which could be available as soon as Nov. 1. There will likely be a short turnaround time to respond to the survey (a week or less), which will require information from human resources, pharmacy, employee health, information technology, and potentially other departments. Hospitals may want to determine now who will respond on behalf of their hospital or health system.

CMS Issues CY 2023 OPPS Proposed Rule

The Centers for Medicare & Medicaid Services (CMS) issued its calendar year (CY) 2023 outpatient prospective payment system (OPPS) proposed rule on July 15. CMS estimates that Medicare expenditures under the OPPS will increase by $6.2 billion relative to estimated current year payments, based on changes in the proposed rule.

The Centers for Medicare & Medicaid Services (CMS) has issued its calendar year (CY) 2021 physician fee schedule (PFS) proposed rule. In addition to addressing annual payment updates for Medicare Part B clinicians and changes to the quality payment program, CMS includes several proposals to make certain COVID-19 telehealth and scope of practice flexibilities permanent, and delays clinical laboratory reporting requirements – including for hospital outreach laboratories – until 2022.

CDPH Updates Quarantine Guidance for Health Care Personnel

Today, the California Department of Public Health (CDPH) released updated guidance on quarantine for health care personnel (HCP). All Facilities Letter (AFL) 21-08.2 aligns with the Centers for Disease Control and Prevention’s (CDC’s) March 10 quarantine and work exclusion guidance for HCP in response to COVID-19 vaccination. Both the CDPH AFL and CDC guidance now recommend that:

CHA Applauds Court Decision to Move Forward With Implementation of New Liver Allocation Policy

A federal judge has denied a motion to delay implementation of the Acuity Circle Model, the new liver transplantation allocation policy approved by the Organ Procurement and Transplant Network (OPTN) in December 2018. OPTN launched the new liver distribution system on May 14. CHA has long supported this important policy.
