Johnson & Johnson Halts Proposed 340B Rebate Model

What’s happening: Johnson & Johnson will stop its plan that would have required hospitals participating in the 340B drug discount program to purchase Stelara and Xarelto at full price and apply for a rebate instead of receiving full discounts upfront.  

What else to know: The Health Resources and Services Administration (HRSA) notified J&J it would be kicked out of the 340B Drug Pricing Program if it did not halt implementation.

CHA Issues Summaries of Federal Interoperability and Information Blocking Final Rules, CMP Proposed Rule

The Department of Health and Human Services (HHS) has published previously released final rules — one from the Centers for Medicare & Medicaid Services (CMS) and the other from the Office of the National Coordinator for Health Information Technology (ONC) — intended to improve the interoperability of health information and define regulations to prevent information blocking. Due to the COVID-19 public health emergency, certain provider compliance and enforcement deadlines have been updated since the regulations were first released on March 9.

CHA Releases Final Draft Model of 2019-21 Hospital Fee Program

Yesterday, the Department of Health Care Services (DHCS) submitted a final draft of the Hospital Fee Program (VI) fee and payment model to the Centers for Medicaid & Medicare Services (CMS). Over the past six months, CHA has worked closely with DHCS in finalizing the next hospital fee program. The model should be considered a final draft until the state receives official CMS approval, though CHA and DHCS do not expect significant changes during the CMS review and approval process.
