CHA Issues Summary of Confidentiality of Substance Use Disorder Patient Records Proposed Rule

CHA has issued a detailed summary, prepared by Health Policy Alternatives, of the two proposed rules on the confidentiality of substance use disorder (SUD) patient information under the 42 CFR Part 2 regulations.

Comments are due Oct. 25 on the proposed rule that makes several changes to regulations governing medical records created by federally assisted substance use disorder programs (FASUD), also known as Part 2 programs.

Comments are due Sept. 25 on the proposed rule clarifying that a court may authorize disclosure of confidential communications made by a patient of a FASUD program in connection with the investigation or prosecution of an extremely serious crime.
