Updated Quarantine AFL Offers Flexibility During Critical Staffing Shortages

Also on Sept. 9, CDPH revised its quarantine guidance for health care workers with the release of AFL 21-08.4. The guidance now includes a section titled “Return to Work for Hospital HCP diagnosed with COVID-19.” This section specifies that during critical staffing shortages, as a last resort, hospitals may consider allowing HCP with suspected or confirmed SARS-CoV-2 infection to work if they are well enough and willing to work, even if they have not met all return to work criteria.  

CMS to Rescind Prior Audit Denials for Mid-Build Exceptions

The Centers for Medicare & Medicaid Services (CMS) announced it is rescinding prior audit denials for hospitals that failed to qualify for the “mid-build exception” to the site-neutral payment policy. CMS will review each previously failing provider’s audit findings for compliance with statutory requirements, as well as for accuracy and completeness.

CDPH Corrects State Cost-Sharing References in Urgent Staffing Shortage AFL

On Sept. 7, CDPH released AFL 20-46.3 on urgent staffing shortages. The only substantive update to this AFL is that the state has discontinued its cost sharing of staffing resources through the state staffing contract. The state previously announced in late spring 2021 that it would discontinue that cost-sharing program, and this AFL removes references to it.

San Joaquin Valley Continues to Transfer Patients Statewide, State Using Public Health Officer Regions for Transfer Trigger

Since Sept. 3, transfers from hospitals in the San Joaquin Valley to hospitals throughout the state have been required when clinically appropriate and capable as determined by the hospital leadership and Medical Health Operational Area Coordinator (MHOAC). This is in place until at least today, Sept. 9. If the San Joaquin Valley continues to remain under 10% ICU capacity for three consecutive days, the requirement for hospitals outside the San Joaquin Valley to accept patients will be extended for another seven-day period under the health order.
