Department of Fair Employment and Housing Provides FAQ on New Pay Data Reporting Law

For in-house counsel, human resources executives

Last week, the California Department of Fair Employment and Housing issued frequently asked questions to assist employers in complying with a new law on pay data (government code 12999/Senate Bill 973) that takes effect on Jan. 1, 2021, and requires reporting no later than March 31, 2021.

The FAQ answers questions about how the data may be submitted electronically, as well as the required content. However, there are several topics — such as determining pay and hours worked — where the document says guidance will be forthcoming. Hospitals and health systems should monitor the FAQ web page to ensure they have the most up-to-date information and can comply with the March 31, 2021, reporting deadline.
