CMS Formally Rescinds Most Favored Nation Part B Drug Model

The Centers for Medicare & Medicaid Services (CMS) issued a proposed rule that would formally rescind its November 2020 Most Favored Nation model interim final rule (IFR).

 In December, a federal court issued a nationwide preliminary injunction preventing CMS from moving ahead with its planned Jan. 1, 2021, implementation of the model and rule. In the proposed rule, CMS notes that it will review comments submitted on the November 2020 IFR to inform future rulemaking on Medicare Part B drug payments.
