Providing care to patients with mental health issues is complicated. It isn’t always easy to know what is “right” and what is “legal.”
The Mental Health Law Manual was written to help hospitals understand the laws governing mental health treatment as well as the rights of the patients they serve. The manual also details special protections for individuals who may be unable to make rational decisions regarding their care, specific requirements regarding the use and disclosure of health information and unique reporting requirements.
New for 2019
The 2019 edition includes a new chapter that analyzes the sometimes-conflicting laws governing who is responsible to pay for services rendered in an Emergency Department (ED) to Medi-Cal patients with mental health conditions. The new chapter:
- Reviews the laws and DHCS interpretations about payment for ED services, including emergency psychiatric services
- Provides arguments that may help hospitals obtain improved reimbursement for mental health services rendered to Medi-Cal patients
- Describes the mental health services covered by mental health plans (MHPs) and managed care plans (MCPs)
- Review the respective obligations of MHPs and MCPs to pay for emergency and post-stabilization services
- Presents multiple scenarios how to respond to a patient that presents to an ED with a complaint that includes a psychiatric condition
Written in a user-friendly manner, the manual has been updated to reflect all changes in state and federal laws governing mental health treatment and privacy through January 2019.
