Model Medical Staff Bylaws & Rules set the framework for the working relationship of the medical staff, hospital administration and governing body, and assures legal protections are in place. The model document stresses quality-of-care responsibilities and accountability and is intended to serve as a template that hospitals can use to develop their own bylaws and rules.
The 2019 Model Bylaws reflect a fresh look at medical staff bylaws in California. CHA members are encouraged to read the executive summary memo for information about how this release differs from previous Model Bylaws releases.
The 2019 Model Rules are compliant with current California statutes and regulations; the Medicare Conditions of Participation; and accreditation standards for The Joint Commission and DNV GL. The Rules also incorporate current case law that specifically affects California hospitals and medical staffs.
NOTE: There are two versions of each Model: the Annotated Version, which includes commentary regarding the Model’s provisions and is useful for understanding the basis, uses, or legal foundation for certain provisions, and the Templates Version, which does not include the commentary and makes it easier to adopt the document or copy and paste specific provisions.
