CHA’s Mental Health Law manual has been expanded to address restraint and seclusion of mental health patients, and has been thoroughly updated to reflect all other changes in the law.
"Over the past decade, the legal and regulatory environment regarding restraint and seclusion has contained conflicting and confusing requirements," stated Sheree Kruckenberg, CHA vice president, behavioral services. "This manual does an excellent job of consolidating state and federal rules into one place, allowing you to review and ensure your hospitals’ compliance."
Issues covered in the new restraint and seclusion chapter include patients’ rights; definitions; intake assessment/care plan; least restrictive alternatives; orders by a physician, including time limits and discontinuation; face-to-face evaluations; patient monitoring; emergency situations; simultaneous restraint and seclusion; prohibited techniques; post-restraint or seclusion review; reporting, documentation and staff training requirements; and involvement of law enforcement.
Also included are survey procedures and questions surveyors will ask to assess compliance with each requirement.
