On June 7, CMS issued a final rule related to the treatment of Medicare Advantage days for the purpose of calculating a hospital’s disproportionate patient percentage. The rule is in response to the Supreme Court ruling in Azar v. Allina Health Services and applies to cost reporting periods starting before fiscal year 2014. CHA is currently reviewing the rule and will make a detailed summary available to members shortly.
