Over the past several months, the U.S. Department of Labor’s Wage and Hour Division (WHD) has finalized two significant regulatory packages — one pertaining to the salary basis test used in determining exempt status, and one pertaining to calculating the “regular rate” or overtime rate for non-exempt employees.

Yesterday, the California Labor and Workforce Development Agency released a web page focused on Assembly Bill 5, the bill that creates a new test for determining independent contractor status. The site includes information for employees and employers, including frequently asked questions. Although many questions remain, this new resource may be helpful to hospital leaders as they review their independent contractor relationships.

The proposal outlines the department’s transition plan within the California Advancing and Innovating Medi-Cal (CalAIM) initiative, related to discontinuing the Cal MediConnect pilot program at the end of calendar year 2022.
